{"id":2432,"date":"2023-11-02T06:17:33","date_gmt":"2023-11-02T06:17:33","guid":{"rendered":"https:\/\/blog.villages.com.au\/?p=2432"},"modified":"2023-11-02T06:17:33","modified_gmt":"2023-11-02T06:17:33","slug":"what-are-the-laws-on-voluntary-assisted-dying-vad-in-each-state","status":"publish","type":"post","link":"https:\/\/blog.villages.com.au\/lifestyle\/what-are-the-laws-on-voluntary-assisted-dying-vad-in-each-state\/","title":{"rendered":"What are the laws on Voluntary Assisted Dying (VAD) in each state?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Voluntary Assisted Dying (VAD) has now been legalised in all States across Australia, with <a href=\"https:\/\/www.health.nsw.gov.au\/voluntary-assisted-dying\/Pages\/default.aspx\">legislation in New South Wales<\/a> coming into effect from the end of November this year.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not yet legal in the Northern Territory or the Australian Capital Territory, although legislation was tabled in the ACT Legislative Assembly on Tuesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Who is eligible for voluntary assisted dying?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ben White, a professor of end-of-life law at Queensland University of Technology, says the laws in Victoria and SA are a problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFamily members and patients have described not being able to find the right words, not being able to generate the right conversation,\u201d he says. \u201cThere\u2019s an issue of health literacy in a voluntary assisted dying setting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Three states \u2013 Queensland, South Australia, and NSW \u2013 include institutional objection provisions in their legislation. In those states, people are generally able to access voluntary assisted dying if they are permanent residents of an aged care or palliative care facility, even if the facility objects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Patients must take the medication themselves unless they cannot self-administer or digest it, in which case a practitioner can administer it.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Voluntary Assisted Dying (VAD) has now been legalised in all States across Australia, with legislation in New South Wales coming into effect from the end of November this year.
